1. Who we are and acceptance
These Terms govern the use of the Persist Notes app and the persistnotes.com website. Persist Notes is developed by Controlled Technology Ltda. (ControlLed), CNPJ 18.305.811/0001-66, headquartered at Av. Cidade Jardim, 414, Bloco Torre 02, Apt 135 – Jardim Satélite, São José dos Campos – SP, CEP 12231-675, Brasil, ("we").
Purchases are made through Paddle (Paddle.com Market Limited), our authorized reseller (merchant of record). When you buy, you also accept Paddle's terms of purchase.
By installing or using Persist Notes, you agree to these Terms and to the Privacy Policy.
2. The service
Persist Notes records meetings on your computer, transcribes the audio locally, and organizes the result in Markdown (.md) files in a folder you choose. The summary is generated by Claude, from Anthropic, through the Claude Code installed on your computer and your own Claude subscription.
We grant you a personal, non-exclusive, non-transferable license to use the app on the computers allowed by your plan, for as long as you comply with these Terms.
3. Account
Some features require an account, identified by your email. You are responsible for keeping access to your email and for everything done with your account. Each plan has a maximum number of computers; you can remove computers through your account. Persist Notes is intended for people aged 18 or older. People under 18 may use it only with the authorization and supervision of a parent or legal guardian.
4. Plans, payment, and renewal
- Free: limits on recording hours, projects, and computers as stated on the pricing page. The free plan limits may change, with at least 30 days' notice.
- Pro and Pro Unlimited: monthly or annual subscriptions, renewed automatically until you cancel. Subscribers keep their subscription price for as long as they don't cancel.
- Founders: a one-time payment offer, limited to 100 participants, that gives access to the Pro Unlimited plan for 5 years from the date of purchase, with no automatic renewal and no additional charges during that period. The offer is personal and non-transferable. At the end of the 5 years, the founder can stay on Pro Unlimited at the launch price in effect on the date of purchase, which remains guaranteed for as long as the subscription is not canceled. The badge, the direct channel, and the roadmap vote are participation benefits, valid for as long as the plan lasts; the vote is advisory and does not bind product decisions. The offer follows the Refund Policy.
- Prices, currency, and taxes appear in the Paddle checkout before payment.
- Cancellation: at any time, through the management link sent in the purchase email. The plan continues until the end of the period already paid.
- Refund: according to the Refund Policy.
A plan limit never interrupts a recording in progress: the recording finishes and is transcribed as usual.
5. Your files
Your recordings, transcripts, and meetings are yours and stay on your computer. We don't have access to them. Your .md files remain accessible in any situation, including on the free plan, with an expired subscription, or without internet. Make backups: we don't keep a copy of your content.
6. Recording meetings
You are responsible for informing participants and obtaining their consent to record, transcribe, and summarize meetings, as required by the law that applies in your country and theirs. You are also responsible for obtaining the consent of the people whose voice profiles you save in the app. We recommend announcing, at the start of each call, that it is being recorded and transcribed.
7. Claude and third-party services
The summary and queries depend on Claude Code and on your direct relationship with Anthropic, governed by Anthropic's terms. We don't control Claude's availability, limits, or prices. Text generated by artificial intelligence may contain errors: review summaries, decisions, and due dates before acting on them.
8. Summaries shared by link
When you create a link to share a summary, you are responsible for the published content and for having the right to disclose it. We may remove links with unlawful content or that violate these Terms. Links expire at the time you choose and can be revoked in the app at any time.
9. Prohibited use
You may not: record people without the consent required by law; use the app or shared links for unlawful content; circumvent plan or computer limits; copy, modify, resell, or reverse engineer the app, except where the law allows; overload or attack the services.
10. Intellectual property
The app, the Persist Notes brand, and the website belong to ControlLed. These Terms do not transfer any rights to them, beyond the license to use described above.
11. Updates and availability
We may release updates that change, improve, or remove features. We will do our best to keep the services available, but we don't guarantee uninterrupted operation.
12. Warranties and liability
12.1 We make every effort for Persist Notes to work as described on the website, and we fix the defects reported to us.
12.2 The app depends on components we don't control: the operating system, the microphone and audio permissions you grant, Claude Code, and your Anthropic account. We are not liable for failures caused by these components.
12.3 Summaries, action items, and answers are generated by artificial intelligence and may contain errors or omissions. Review them before making any decision based on them; we are not liable for decisions made without that review.
12.4 We don't keep a copy of your recordings, transcripts, or meetings. For that reason, we are not liable for loss of data on your computer. We recommend regular backups.
12.5 To the extent permitted by law, our total liability for damages arising from the use of the app is limited to the amount you paid us in the 12 months before the event that caused the damage, and does not include lost profits or indirect damages.
12.6 Nothing in these Terms excludes or limits rights guaranteed by Brazil's Consumer Protection Code (CDC) or by other law applicable in your country, including with respect to product defects and damages caused by willful misconduct or gross negligence.
13. Termination
You can stop using the app and delete your account whenever you want. We may suspend accounts that violate these Terms. In any case, your files stay on your computer.
14. Changes to these Terms
If these Terms change in a significant way, we will notify you in advance by email or in the app.
15. Governing law and venue
These Terms are governed by Brazilian law. The courts of the judicial district of São José dos Campos, State of São Paulo are chosen as the venue, without prejudice to the consumer's right to the courts of their place of residence.
